Facts
The Environmental Protection Agency (EPA) and the state of Arkansas’s environmental agency cleaned up a site of hazardous waste. The EPA then forced Signature Combs, Inc. (Combs) (plaintiff) to reimburse the EPA for the cleanup costs under the Comprehensive Environmental Response, Compensation and Liability Act (CERCLA). Combs in turn sued Mason and Dixon Lines, Inc. (MDL) (defendant) under CERCLA for contributions to the cleanup costs. MDL filed a motion for judgment on the pleadings, contending that Combs’s CERCLA claims were discharged in MDL’s bankruptcy.
