Facts
Joanne Simeonidis (plaintiff) suffered back injuries when her slot machine chair suddenly collapsed at a casino operated by Mashantucket Pequot Gaming Enterprise (defendant). Simeonidis had a preexisting back problem but had completed her physical therapy just three days before the casino incident and was told she could continue her exercises at home. After the incident, she resumed physical therapy and received spinal injections. Six months later, Simeonidis underwent spinal-fusion surgery. In the ensuing negligence suit, two experts offered conflicting opinions but could not say with medical certainty that the casino incident alone necessitated the need for surgery.
