Facts
Levi Philips was the executor for the estate of decedent Simon (plaintiff). The civil trial for a case against Gratz (defendant) related to the estate was set to occur on a Saturday. Philips, who was Jewish, requested a continuance of the trial due to the Sabbath. The court declined to continue the case. Philips was forced to nonsuit and appealed to the Pennsylvania Supreme Court.
