Facts
The United States District Court for the District of Connecticut entered an order preliminarily enjoining Roderick Bremby, commissioner of the Connecticut Department of Social Services (DSS) (defendant) from imposing a penalty on Dawn Simonsen (plaintiff) that would render her ineligible for Medicaid benefits. DSS based the penalty primarily on its determination that two decanted trusts (predecessor trusts) constituted support trusts, which, under Connecticut law, were considered available resources to a beneficiary. The district court found that DSS had employed a more restrictive methodology than that used to determine federal Supplemental Security Income (SSI) eligibility. DSS appealed the district court’s order granting the preliminary injunction.
