Facts
Skidmore (plaintiff) filed a lawsuit in federal district court alleging negligence and seeking damages against Baltimore & Ohio Railroad Co. (defendant). Before jury deliberations began, Baltimore requested that the jury be required to return a special verdict, which would require the jury to make specific findings as to negligence of each party and damages. The judge denied that request and required the jury to return only a general verdict. The jury ruled in favor of Skidmore and awarded damages in the amount of $30,000. Baltimore appealed.
