Facts
Slocum (plaintiff) was a customer in a Food Fair store (defendant). Slocum asked an employee the price of an item and the employee responded “if you want to know the price, you’ll have to find out the best way you can…you stink to me.” Slocum subsequently suffered emotional distress, and a heart attack. Slocum sued Food Fair for intentional infliction of emotional distress. Slocum’s complaint was dismissed for failure to state a cause of action and she appealed to the Supreme Court of Florida.
