Facts
Tonya and Rachel Smith (plaintiffs) were two women married to each other. The Smiths sought to rent housing owned by Deepika Avanti (defendant). Avanti expressed concern about the Smiths’ “unique relationship,” and she refused to rent to them. The Smiths brought suit against Avanti, contending that she discriminated on the basis of sex in violation of the Fair Housing Act (FHA). The Smiths filed a motion for summary judgment. The district court took the motion under advisement.
