Facts
Sony Music Entertainment, Inc. (Sony) (plaintiff) owned the rights to certain music recordings. According to Sony, 40 individuals (the users) (defendants) used a file-sharing network called Fast Track to download and distribute Sony’s music recordings without Sony’s permission. Sony identified Cablevision as the internet-service provider that provided internet access to the users. In Cablevision’s terms of service, it specified that users could not use Cablevision’s services to transmit or distribute any material in violation of any law or regulation. Sony subpoenaed Cablevision, seeking the identities of the users who had used Fast Track to download and distribute Sony’s music without authorization. The users subsequently moved to quash the subpoena.
