Facts
A party injured by an intoxicated minor (plaintiff) filed a claim against a vendor (defendant) for the negligent sale of alcohol to a person that the vendor either knew or should have known was a minor. The trial court dismissed the claim for failure to state a claim upon which relief can be granted, relying on precedent that the furnishing of alcohol to an intoxicated person was not the cause of the injury. The injured party appealed.
