Facts
Bushmaster Firearms International, LLC, and related companies manufactured the semi-automatic Bushmaster XM15-E2S rifle (XM15-E2S); Camfour and related companies were distributors that purchased XM15-E2S rifles and resold them to Riverview (collectively, the gun parties) (defendants). Riverview sold an XM15-E2S to Nancy Lanza. Lanza’s son, Adam Lanza, used the XM15-E2S to kill 20 children and six staff members and wound two staff members at Sandy Hook Elementary School. The estates of nine victims (plaintiffs) sued the gun parties pursuant to Connecticut’s wrongful-death statute for, among other claims, violating the Connecticut Unfair Trade Practices Act (CUTPA). The estates alleged that the gun parties advertised and marketed the XM15-E2S in an unethical, oppressive, immoral, and unscrupulous manner that emphasized the militaristic and assaultive qualities of the rifle and its suitability for offensive, military-style combat missions. The trial court granted the gun parties’ motion to strike the wrongful-marketing allegations. The estates appealed.
