Speer v. Quinlan
Idaho Supreme Court
525 P.2d 314 (1973)
- Written by Whitney Kamerzel , JD
Facts
Raymond Speer (plaintiff) married Olive Speer (defendant). Before the marriage, Raymond was gifted stock in the family business from his parents. During the marriage, Raymond’s stock increased in value from $100 to $818.43 per share. During the period the stock increased in value, Raymond accepted a decreased salary and worked nights and weekends. Olive also entertained business guests. At divorce, the trial court awarded Olive a community-property interest in the increased stock value due to the community’s contributions. The trial court did not compare Raymond’s salary with those of similarly situated employees to determine whether Raymond’s salary was already sufficient to compensate the community. Raymond appealed.
