Facts
Johnson & Johnson (J&J) (defendant) manufactured, marketed, and sold prescription opioid painkillers in Oklahoma. Mike Hunter, in his capacity as attorney general of Oklahoma (plaintiff) sued J&J, arguing that the company helped create a public nuisance in the form of the opioid drug epidemic by overstating the benefits of opioids, understating their dangers, and hiding the lack of evidence supporting the drugs’ long-term use. The trial court held J&J liable under Oklahoma’s public-nuisance statute. J&J appealed to the Oklahoma Supreme Court.
