Facts
Cecil Grose (defendant) shot Jamie Forbes, who was hospitalized with two serious gunshot wounds. Forbes fell into a coma. Days later, to spare Forbes from further suffering and allow her to die with dignity, Forbes's parents instructed hospital staff not to resuscitate her should her heart or lungs stop functioning. Soon thereafter Forbes died, and the state of Tennessee (plaintiff) prosecuted Grose for homicide. The state proved that, had Forbes not been hospitalized, she would have died from her wounds within hours, and that the cause of death was those wounds. The jury convicted Grose, and he appealed to the Court of Criminal Appeals of Tennessee. Grose argued that the immediate cause of Forbes' death was not the gunshot wounds but her parents' nonresuscitation instruction.
