Facts
Michael Kman and Ryan Shover (defendants) were indicted for murder. The state (plaintiff) moved to sever Kman and Shover’s trials because the state would be presenting testimony from coconspirators that Kman confessed to the murders and implicated Shover, which would not be constitutionally permitted in a joint trial. Rather than having two separate trials, the state moved to try Kman and Shover simultaneously before two separate juries.
