State v. Williams
North Carolina Court of Appeals
635 S.E.2d 495 (2006)
- Written by Meredith Hamilton Alley, JD
Facts
Cheryl Williams (plaintiff) and her ex-husband, Michael Williams (defendant) had three children. During the divorce, Cheryl testified that her father paid $1,550 per month for her rent and $340 per month for her car payment, for a total of $1,890 per month. Cheryl expected that her father would continue making the payments until her lease ended and her car was paid off. The trial court found that Cheryl’s father made the payments on her behalf to hide Cheryl’s income and assets from the court. In calculating the amount of child support, the trial court did not take the payments into account and determined that Cheryl’s gross monthly income was about $890. Michael appealed, arguing that the trial court should have considered the payments as income.
