Facts
Katherine Harcsar (defendant) sought a church annulment of her sacramental Catholic marriage to Stephen Purdum (plaintiff). If the church granted the annulment, Harcsar could be remarried in a Catholic church ceremony. Harcsar made an annulment petition to the church tribunal, which sent a copy to Purdum. In the petition, Harcsar claimed that Purdum was bipolar. Purdum sued Harcsar for defamation, claiming that Harcsar’s bipolar claim was false. Harcsar argued that her statements to the tribunal were privileged and that Purdum had consented to the tribunal’s jurisdiction over the marriage during their marriage ceremony. The trial court dismissed the case, and Purdum appealed.
