Facts
Bradford Stinson (plaintiff) was required by his employer to undergo a drug test at a facility run by Physicians Immediate Care, Limited (Physicians) (defendant). Physicians reported to Stinson’s employer that he had tested positive for cocaine, and Stinson was fired as a result. Stinson sued Physicians for negligence, claiming that the positive result was not accurate. The trial court dismissed Stinson’s claims on the grounds that Physicians did not owe him a duty of care. Stinson appealed.
