Facts
Swift & Co. Packers (Swift) (plaintiff) owned goods that were being transported by a ship owned by Transmaritima that sunk in the Caribbean. Swift filed a complaint against Compania Colombiana Del Caribe, S.A. (Del Caribe) (defendant) and others seeking attachment of a ship known as the Caribe, which was originally owned by Transmaritima but transferred to Del Caribe, as compensation for the loss of its goods. The Caribe was attached by the marshal. Del Caribe filed a motion to dismiss the complaint and vacate the attachment. The trial court vacated the attachment, and Swift appealed. The court of appeals affirmed the trial court’s order, and Swift appealed again.
