Facts
State authorities executed a search of casinos on the reservations of Bands of Mission Indians (the bands) (plaintiffs), including the Sycuan Band of Mission Indians. The state attempted to prosecute casino employees for operating video pull-tab machines classified as class III slot machines in violation of the Indian Gaming Regulatory Act (IGRA) and state law. The state argued that it had authority to enforce its laws under Public Law 280. The bands brought suit for declaratory relief as to classification of the machines and injunction to stop the prosecutions. The district court granted the injunction. The state appealed.
