Facts
Sarah Lewis purchased and soon after took possession of a property, although it is unclear whether she had perfect title. When she died, there was no evidence that her heirs took over possession of the property. However, seven years after her death, a third party named Tapscott (defendant) took possession of the property with no claim to title. Cobbs (plaintiff) is the heir of Mrs. Lewis. Cobbs brought this action for ejectment against Tapscott. The lower court ruled in favor of Cobbs. Tapscott appealed.
