Facts
In 2011, the Douglas County School District (defendant) created the Choice Scholarship Pilot Program (CPS) that provided taxpayer-funded scholarships to elementary, middle, and high-school students. The CPS partnered with private schools, including religious schools, to provide financial aid for the tuition of selected students to attend the participating private school of their choice. Taxpayers for Public Education and other groups (plaintiff) filed a lawsuit, arguing that the CPS was unconstitutional under the Colorado Constitution’s prohibition on the use of public funds to support or sustain churches and church-run schools.
