Facts
Taylor (plaintiff) was driving her car down a road when it crashed into a fallen tree. The tree was alleged to have fallen from the land of Marion Olsen (defendant). Upon inspection of the tree, it was found that the center was decaying, but that this decay was unobservable without chopping or drilling into the trunk. Taylor brought suit against Olsen for her injures. The trial court entered a directed verdict in favor of Olsen. Taylor appealed.
