Facts
Under Texas law, religious organizations were exempt from paying sales tax on periodicals or publications promoting or teaching about the religion. Texas Monthly, Inc. (Texas Monthly) (plaintiff), was a magazine publisher that did not qualify for the religious exemption. Texas Monthly sued the state (defendant), arguing that providing tax exemptions for religious publishers but not non-religious publishers violated the Establishment Clause of the First Amendment. The district court found the exemption to be unconstitutional. The court of appeals reversed, and Texas Monthly appealed.
