Facts
Two Kentucky citizens (plaintiffs) filed a lawsuit in a Kentucky state court against an Indiana corporation, Thermtron Products, Inc. (defendant), seeking damages for injuries sustained in an automobile accident. Thermtron removed the lawsuit to federal district court based on diversity jurisdiction. The district court entered an order remanding the case to state court, ruling that due to its crowded docket, the case could proceed in a timelier fashion in state court. Thermtron filed a petition for a writ of mandamus or prohibition with the United States Court of Appeals for the Sixth Circuit. The court of appeals denied the petition, and the United States Supreme Court granted certiorari.
