Thousand Oaks Barrell Co., LLC (Thousand Oaks) (plaintiff) was a Virginia company with its principal place of business in Virginia. Thousand Oaks made and sold miniature bourbon barrels that could be used as beverage containers, cigar humidors, and wedding card depositories. Thousand Oaks claimed that Deep South Barrels LLC (Deep South) copied Thousand Oaks’s products. Thousand Oaks filed a diversity action against Deep South. Among other causes of action, Thousand Oaks asserted a claim for common-law misappropriation under Virginia law.
