Facts
Wang Antao (defendant), a former employee of Tianli Project Advisory Company (Tianli) (plaintiff), acquired an illegal copy of Tianli software and asked another former employee to make modifications to it. Wang then set up a company, Honghan Software System Company, Ltd., for the purpose of selling the software. Tianli sued Wang for infringement. There was evidence that Wang’s requested modifications had not been made. The trial court ruled in favor of Tianli, ordering Wang to compensate Tianli for any losses. Wang appealed to the Hangzhou City Intermediate People’s Court.
