Facts
John Trahan (defendant) owned a residence. He married Betty Trahan (plaintiff). During the marriage, John purchased insurance on the home. The home burned, and the insurance company paid out $46,560. Later, John and Betty’s marriage was dissolved. The trial court credited the bulk of the insurance proceeds to John as separate property. Betty appealed, arguing that insurance proceeds acquired during a marriage were community (i.e., marital) property. The Louisiana Court of Appeal granted certiorari.
