Facts
The survivors and representatives of the estates of Eulalia Mayorga and Emma Trejo (plaintiffs), Texas citizens, sought wrongful-death and survivor damages in a Texas state court from Transportes Del Norte (TDN), a Mexican bus company, and Trailways, Inc., a bus company operating out of Texas. The decedents’ representatives alleged that TDN’s driver’s negligence resulted in the death of the decedents and that both TDN and Trailways were responsible. The trial court found TDN negligent and, applying Texas law, the trial court awarded damages against both TDN and Trailways. TDN and Trailways appealed. TDN contested the application of Texas law against it for its driver’s alleged negligence that occurred in Mexico.
