Facts
Zavicha Blagojevic, a French resident, sued a Japanese company, Daiei K.K., for damages in a breach-of-contract action filed in France. Blagojevic served Daiei in the French action by mailing the summons and complaint to Daiei in Japan. Blagojevic failed to provide Daiei with a Japanese translation of the legal documents. After Blagojevic obtained a judgment against Daiei in the French action, Blagojevic tried to enforce the judgment in Japan. Daiei’s bankruptcy trustee, Ueno (plaintiff), filed a declaratory-judgment action against Blagojevic in Japan, arguing that the judgment was unenforceable.
