Facts
An Austrian seller (defendant) notified a Canadian buyer (plaintiff) that delivery would be suspended for two weeks, pending receipt of the buyer’s letter of credit. When the goods arrived eight weeks later, the buyer found the goods to be nonconforming. The buyer sued for breach of contract, including late delivery. The case reached British Columbia’s supreme court.
