Facts
Berrigan (defendant) was charged with damaging and destroying draft records. Criminal statutes made damaging and destroying draft records a crime. Berrigan wanted to defend himself by arguing that the war in Vietnam was immoral and illegal and that his actions were done in protest of that war.
