Facts
The Aryan Brotherhood (AB) was a prison gang operating in California and federal prisons. The AB was headed by a commission, which was responsible for making decisions that would be implemented by AB’s council. The AB’s leadership maintained enemy hit lists and routinely ordered murders, which AB members were expected to carry out. Edgar Hevle (defendant), a long-time member who served on the council, sent a message ordering AB members at a prison to prepare for the murders of two rival gang members, Frank Joyner and Abdul Salaam. Hevle was convicted of violating the Racketeer Influenced and Corrupt Organizations (RICO) Act, conspiring to violate the RICO Act, and murder. Hevle appealed.
