Facts

Elayne Cohen-Strong and her infant daughter resided at a mobile-home lot leased from California Mobile Home Park Management Company (management company) (defendant). Cohen-Strong’s daughter had a respiratory disease, such that she required care from a home medical aide. The management company had a policy that required residents to pay fees for the presence of long-term guests. Cohen-Strong requested that the management company waive the guest fees charged for the presence of her daughter’s home medical aide. But the management company rejected Cohen-Strong’s request. Subsequently, the government (plaintiff) brought suit against the management company on Cohen-Strong’s behalf, contending that the management company violated the Fair Housing Act (FHA). Although the factual record lacked sufficient detail, the district court granted the management company’s motion to dismiss. Because the government refused to appeal, Cohen-Strong intervened in the case and appealed the district court’s decision.
