Facts
The Conservation Chemical Co. (CCC) (defendant) site contained numerous hazardous substances. Humans and animals that entered the CCC site faced exposure to hazardous substances. In addition to those humans and animals visiting the CCC site, organisms offsite may have also been exposed to hazardous substances migrating from the CCC site via groundwater, surface water, or air. The groundwater, surface water, and air that the substances may have reached were part of the environment that the Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA) was designed to protect.
