Facts
On December 20, 1989, United States armed forces were deployed to Panama and engaged in hostilities with Panamanian forces. As a result of the operation, General Noriega (defendant), the head of the Panama Defense Forces, was arrested. Noriega was later tried and convicted in the United States District Court for the Southern District of Florida. Before sentencing, Noriega argued that he was a prisoner-of-war (POW) under the Geneva Convention and that he must receive the protections afforded to POWs at the prison facility where he would serve his sentence.
