Jerry Penton (plaintiff) showed A.K., a minor child, a child-pornography video featuring a minor female child engaging in sexual conduct with an adult man. Immediately after showing A.K. the pornographic movie, Penton stripped A.K. of her clothing and sexually molested A.K. while simultaneously sexually stimulating himself. Penton was charged and convicted under the Adam Walsh Child Protection and Safety Act of 2006 (the Walsh Act) for providing child pornography to a minor for the purpose of inducing the minor to engage in illegal sexual conduct. Penton was sentenced to four years in prison. Penton appealed, arguing that the jury had insufficient evidence to convict.
