Facts
The United States (plaintiff) brought a Comprehensive Environmental Response, Compensation & Liability Act (CERCLA) contribution action against landowner R.W. Meyer, Inc. (R.W. Meyer) (defendant), lessee of the property Northernaire Plating Company (Northernaire), and Northernaire’s principal shareholder, Garwood. The United States sought to recover removal costs for clean-up under CERCLA. The trial court found joint and several liability against R.W. Meyer, Garwood, and Northernaire. In the contribution action, the district court imposed two-thirds of the liability on Northernaire and Garwood and one-third on property owner R.W. Meyer.
