Facts
Universal Music Group (UMG) (plaintiff) brought suit against Veoh Networks (defendant) for copyright infringement after it discovered that users of Veoh’s service had been downloading and sharing videos containing music for which UMG owned the copyright. Veoh made an offer of judgment pursuant to the procedures in Federal Rule of Civil Procedure 68 for the amount of $100,000, which UMG declined. The district court granted summary judgment to Veoh after it determined that Veoh’s activities fell within the Digital Millennium Copyright Act’s (DMCA) safe harbor and was therefore protected. The parties thereafter stipulated that Veoh continue to manage its users’ infringing activities and that UMG wasn’t entitled to any further relief. Veoh appealed the district court’s refusal to grant it costs and attorney’s fees under FRCP 68.
