Valles v. Daniel Construction Co.
Tennessee Supreme Court
589 S.W.2d 911 (1979)
- Written by Abby Roughton, JD
Facts
Teodoro Valles (plaintiff) was injured at work and brought a workers’-compensation action against his employer, Daniel Construction Company (Daniel) (defendant), and Daniel’s insurance carrier, Aetna Life & Casualty Insurance Company (Aetna) (defendant). Under Tennessee law, which applied to Valles’s action, a claimant’s workers’-compensation payments could be paid in a lump sum if the court allowed. Valles and Daniel agreed to a lump-sum payment of Valles’s workers’-compensation benefits, but Aetna objected. The trial court approved a lump-sum settlement over Aetna’s objection. Aetna appealed, asserting that Aetna was not bound by the Valles-Daniel agreement and could not be forced to make a lump-sum payment to Valles.
