Facts
The Valley Bank of Nevada (bank) (plaintiff) sued to recover on a promissory note. The borrowers defended, alleging that the bank misrepresented the availability of alternative financing to get the borrowers to agree to the transaction. To prove their contention, the borrowers sought to discover information about transactions between the bank and some other customers. The bank objected and alleged that it was entitled to protect the privacy of its customers and refused to disclose information about the confidential transactions of its customers. The trial court ordered the bank to disclose the information. The bank sought a writ of mandate or prohibition to order the trial court to issue a protective order.
