Facts

In December 1989, an anonymous report was made alleging Ms. Valmonte (plaintiff) slapped her daughter on the face. Investigators from the Department of Social Services (DSS) subsequently determined that Valmonte had engaged in excessive corporal punishment and marked her complaint as indicated on the state central register for child abuse. Valmonte’s case was referred to family court and later dismissed, but the dismissal had no effect on her inclusion on the central register. Valmonte’s request for expungement of her report was denied by DSS on application, and again after an administrative hearing. Valmonte then filed suit in the district court alleging that the statutory scheme for the central register violated her due-process rights. The district court dismissed Valmonte’s claims, and she appealed.
