Facts
Jeff Rosenberg (defendant), Gilbert Rosenberg, and Chris Moore co-owned a company, Seascape Restaurants, Inc., which operated the Magic Moment Restaurant. Van D. Costas (plaintiff) entered into a contract with Jeff to remodel the restaurant. Jeff signed the contract as “Jeff Rosenberg, The Magic Moment.” A contract dispute arose. Costas filed a claim for breach of contract. Judgment was entered for Jeff. Costas appealed to the Florida District Court of Appeal.
