Facts
The water system in the city of Phoenix (the city) (defendant) was owned and operated by the city. Russell and Thelma Veach (plaintiffs) owned property that was located in an area served by the city’s water system. But the city did not install a fire hydrant near the Veaches’ property. A fire broke out on the Veaches’ property. Due to the lack of a nearby fire hydrant, the Veaches’ property was completely destroyed by the fire. The Veaches brought suit against the city, seeking compensation for the property damage caused by the fire. The city filed a motion to dismiss for failure to state a claim. The trial court granted the motion and dismissed the Veaches’ complaint. The Veaches appealed.
