Facts
Various residents of a neighborhood (plaintiffs) brought suit against Velsicol Chemical Corporation (Velsicol) (defendant) for damages alleged to have been caused by pollution from Velsicol’s manufacturing plant. However, Velsicol asserted that five other chemical companies in the area had also contributed to the pollution. Velsicol filed a complaint against the five third-party companies, which the companies moved to dismiss. The trial court granted the motion. Velsicol appealed to the Tennessee Supreme Court.
