Facts
The California Fish & Game Commission (defendant) passed the Channel Islands Marine Protected Area Project, which created no-take zones in areas the state controlled around the California coast. The project was enacted to address a historic decline in fish stocks and a decline in fish habitat. The Ventura County Commercial Fishermen’s Association (plaintiff) sued, asking for a temporary restraining order to stop the project. The court denied the temporary restraining order, and the association appealed.
