Facts
Venture Corporation Ltd. (plaintiff) brought a federal patent-infringement suit against James Barrett (defendant). Barrett asked Venture to produce 41,000 pages of relevant discoverable documents, organized and labeled so as to make clear to which discovery request each document responded. However, the parties were unable to agree on the format in which Venture would produce its documents. Venture converted the documents to electronically stored information (ESI) in the form of PDF or native-format files, which Venture turned over to Barrett without any index, table, or other information as to how the ESI was organized. Barrett moved to compel Venture’s disclosure of that organizational information.
