Robert Mitchum starred in the nationally released theatrical film The Story of G.I. Joe (G.I. Joe). The 108-minute-long film was frequently shown on television. When Mitchum died, several news networks created short obituary pieces that included clips from Mitchum’s films, including G.I. Joe. The longest G.I. Joe clip used in an obituary segment was 22 seconds, and none of the segments revealed significant aspects of the film. Video-Cinema Films, Inc. (plaintiff) sued news networks Cable News Network, Inc., American Broadcasting Companies, Inc., and CBS Corporation (collectively, the networks) (defendants) in federal court for copyright infringement. The networks filed a motion for summary judgment.
