Facts
The Village of Chatham (plaintiff) reached an agreement with owners of undeveloped, unincorporated land in the County of Sangamon (defendant) to annex their land. The county informed the landowners and the village that the landowners needed to obtain county-issued construction permits prior to commencing development. The village filed suit for a declaratory judgment that it, and not the county, had zoning and building-code jurisdiction over the properties subject to the annexation agreement. The trial court granted the village summary judgment. The appellate court affirmed. The county appealed.
