Village of Willowbrook v. Olech
United States Supreme Court
528 U.S. 562 (2000)
- Written by Sean Carroll, JD
Facts
Olech (plaintiff), a resident of the Village of Willowbrook (defendant), asked the Village to connect her property to the municipal water supply. The Village agreed to do so if Olech granted it a 33-foot easement. The Village only required a 15-foot easement from other residents. Olech sued the Village claiming a violation of the Equal Protection Clause. The district court dismissed for failure to state a cause of action. The United States Court of Appeals for the Seventh Circuit reversed. The United States Supreme Court granted certiorari.
