Facts
The City of Farmers Branch, Texas (the city) (defendant) enacted an ordinance requiring apartment owners and managers to obtain evidence of citizenship or eligible immigration status before renting to tenants. The ordinance included numerous references to federal Department of Housing and Urban Development (HUD) regulations and defined eligible immigration status in reference to HUD regulations used for determining noncitizens’ eligibility for federal housing subsidies. Villas at Parkside Partners (plaintiff) challenged the ordinance and requested partial summary judgment, asking the court to find that the ordinance was preempted by federal law and was thus unconstitutional and to enjoin the city from enforcing the ordinance.
